Enforcing the insurance policy

We are currently acting for a Northern based business whose insurers have repudiated the insurance policy and refused to make any payment following a fire which destroyed our client's premises, on the grounds that the insurance policy contained a warranty requiring all external doors to be securely locked.

On the morning of the fire an external door was found to be open. The insurer's forensic fire expert concluded that this meant that the door had been left in an insecure state.

    However, a further forensic investigation commissioned by us discovered evidence not referred to by the insurers' forensic fire investigator, which indicates that entry to the premises was forced by other means and that the open door was in fact the escape route of the intruder.
